U.S. Residents Privacy Notice

In addition to California residents (whose rights are set forth in the California Privacy Notice), residents of other U.S. states may have additional rights under applicable privacy laws and be entitled to additional disclosures. You should consult this document in addition to Via’s primary Privacy Notice. Please refer to the information in this U.S.  Privacy Notice if there are any conflicts between the two. The terms used in this U.S. Residents Privacy Notice have the same definitions provided in the Privacy Notice, unless they are expressly given a new definition here or in the applicable law.

As with the primary Privacy Notice, this U.S. Residents Privacy Notice does not apply to instances in which Via serves as a processor or service provider to Enterprise Customers. In those instances, Via will collect, use, share, disclose, and otherwise process personal information of individuals using their services as directed by each individual Enterprise Customer.

Personal data” or “personal information” under applicable U.S. privacy laws, generally means any information that is linked or reasonably linkable to an identified or identifiable individual (and usually does not include publicly available information that is lawfully made available from government records, or that a consumer has otherwise made available to the public; de-identified or aggregated consumer information; or other information excluded from the states laws scope).

Sensitive data” includes data revealing racial, ethnic or national origin; religious beliefs; information regarding an individual’s medical history, mental or physical health condition, diagnosis or medical treatment; neural data; status as transgender or non-binary; sex life or sexual orientation; status as a victim of a crime; citizenship or immigration status; genetic or biometric data; Personal information collected from or concerning a known child; and precise geolocation data. Where required under applicable law, we will obtain your consent before collecting sensitive data. In addition, while we do not collect personal information from children, we apply additional safeguards for information related to children that might be shared with us when we provide service designated to children to our Enterprise Customers. Please see the Children’s Personal Information paragraph under the main Privacy Notice for more information.

Categories of Personal Information & Categories of Third Parties with Whom Personal Information is Shared:

Under the paragraphs What Personal Information is Collected” and “How We Use Personal Information” of our main Privacy Notice, we describe our collection and processing of personal information, the categories of personal information that are collected or processed, and the purposes for which personal information is processed, stored or used. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without obtaining your consent, unless we are otherwise entitled, required or permitted under applicable laws.

Additionally, the paragraph “How We Share or Disclose Personal Information” of our main Privacy Notice, we detail and disclose the categories of third parties we share personal information with for a business purpose.

Targeted Advertising and Analytics

Our use of tracking technologies, such as pixels or cookies, may be considered a “sale” or “sharing” of personal information under applicable law but we do not otherwise sell your personal information. We use third-party tools that market our Via Services online, measure the marketing efforts, identify users that are interested in our Via Services, etc. This is done by placing tracking technologies on our Via Website. By placing these technologies, we may share information, such as device information, online identifiers, and online behavior information, with these third parties. These disclosures may qualify as the sale of personal information or the sharing or processing of personal information for the purpose of displaying advertisements that are selected based on personal data obtained or inferred over time from an individual’s activities across businesses or distinctly-branded websites, applications, or other services (otherwise known as “targeted advertising”).

You can opt out of the use of your personal information for these purposes at any time through our cookie preference tool on our Website or by contacting us as provided below.

We do not sell or share for targeted advertising purposes the personal information of individuals we know to be “minors” or “children” as such terms are defined under applicable law, as our Services are not designed for use by individuals under this age threshold.

Consumer Rights:

In addition to the rights listed in the “Your Rights” section of our main Privacy Notice, and as detailed in the Targeted Advertising and Analytics, residents of certain U.S. states may have additional rights under applicable privacy laws, subject to certain limitations, which may include:

  • Right to know third parties. You may have the right to request a list of the specific third parties with whom we have shared your personal information.
  • Right of non-discrimination. You have the right not to be discriminated against for exercising your privacy rights

Certain Via Apps may have an in-app deletion function, which you may use to delete your account information. You can also use the cookies preference management tool on our website to change your preferences and opt-out of targeting cookies. For details on unsubscribing from marketing communications or changing your communication preferences, please refer to the Privacy Notice. We will comply with all applicable laws governing your requests. Please note that we may need to verify your identity before processing your request, which may require us to collect additional personal information from you. We may decline a request to exercise the rights listed above, consistent with applicable laws. If your exercise of any of the rights listed above limits our ability to process personal information, we may not be able to provide some or all portions of the Via Services to you going forward.

We will respond to your request within the timeframe required by applicable law. We may extend this period as permitted by law. If we decline your request, we will notify you and provide the reasons for our decision.

Depending on your state of residence, you may have the right to appeal our decision regarding your privacy rights request. To submit an appeal, please email support@ridewithvia.com with a summary of your original request and the decision you wish to appeal.

We will respond to your appeal within the timeframe set by applicable U.S. privacy laws, informing you in writing of any action taken or not taken, along with an explanation of our decision. If you are not happy with our response, depending on your jurisdiction, you may have the right to lodge a complaint against us with the relevant State’s Attorney General:
